Abolition of Arrest Provisions under GST: A Welcome Step Towards a Trust-Based Tax Regime. Read the key points, why it matters and what businesses should watch next.

GST Council Moves to Drop Arrest Powers

The GST Council, at its 57th meeting on 8 October 2026, recommended removing the arrest provisions under the Goods and Services Tax framework. It also proposed raising the monetary threshold for prosecution from ₹1 crore to ₹5 crore and rationalising certain offences. The recommendations follow long-standing debate over the use of arrest powers, which currently flow from Section 69 of the CGST Act, 2017, read with the specified offences listed under Section 132.

Why This Matters for Businesses

Under the existing scheme, the Commissioner may authorise arrest in cases involving specified offences, subject to the conditions laid down in the statute. While intended to deter wilful evasion, the provision carries significant consequences for personal liberty, business reputation and continuity of operations. Its impact extends beyond the taxpayer to employees, suppliers and other stakeholders. The Council's proposal seeks to distinguish deliberate fraud from genuine commercial disputes or inadvertent errors, on the reasoning that recovery of dues and penal action can proceed through other routes. The GST law already provides mechanisms for determining liability, recovering unpaid amounts and imposing penalties, including under Sections 73, 74 and 79 of the CGST Act, as applicable to the relevant tax period.

Revenue Growth in the Background

The reform comes amid steady expansion of GST collections. Official figures cited place gross GST mop-up at roughly ₹11.37 lakh crore in FY 2020–21, rising to about ₹22.27 lakh crore in FY 2025–26, alongside a wider taxpayer base. The Council's recommendations are positioned as a step towards a trust-based compliance culture rather than any dilution of the obligation to pay lawful taxes. The Union Finance Minister, Smt. Nirmala Sitharaman, and the Council have been credited with the initiative.
